Right-Fit Guarantee

“Each Sip™” means the refrigerator filter offered by Second Nature that is designed to improve the taste of your water. Please see https://www.secondnature.com/products/fridge-filters for more information.

“Filter” means either the Each Sip™ or It Matters™ filter purchased by the consumer.

“It Matters™” means the refrigerator filter offered by Second Nature that is designed to improve the taste and reduce certain contaminants in your water. Please see https://www.secondnature.com/products/fridge-filters for more information.

THIS GUARANTEE GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

This limited warranty referred to as the“Right-Fit Guarantee” (the “Guarantee”) can be found online at https://www.secondnature.com/ff-right-fit.

WHO MAY USE THIS GUARANTEE?

Second Nature Brands, Inc. (“SecondNature”) extends this Guarantee only to the United States consumer who originally purchased the Filter (“you”).

WHAT DOES THIS GUARANTEE COVER?

Second Nature warrants that if you use the ordering process located at https://my.secondnature.com/subscribe/products (the “Selection Tool”) and answer the questions asked accurately, that the Filter delivered to you will be Compatible with your refrigerator. “Compatible” means aFilter that will attach to your refrigerator and function in a substantially similar manner as the original equipment manufacturer (OEM) filter would; provided, however, the issue of whether a Filter is Compatible does not include the taste or filtration capabilities of the Filter. If after answering all questions provided by the Selection Tool accurately, you receive a Filter that is not Compatible with your refrigerator, you will be entitled to the remedies set forth below during the Guarantee Period (as defined below).

WHAT ARE YOUR REMEDIES UNDER THIS GUARANTEE?

The remedies available under this Guarantee are as follows and will be provided in the order set forth below:

1.     A free replacement filter with an updated/corrected model number (SKU) of the same quality and brand(e.g., an Each Sip™ replacement filter will be provided if the initial purchase was of an Each Sip™ filter) (a “Replacement Filter”) with shipping and handling paid for by Second Nature.

2.     If the Replacement Filter in 1. above is also not Compatible with your refrigerator, then Second Nature will provide a full refund to you.

Under no circumstances will your recovery under this Guarantee exceed a refund of the purchase price paid for theFilter. If Second Nature does not carry a model of filter of the same quality and brand as the Filter that will beCompatible with your refrigerator, Second Nature may skip remedy 1. above and immediately provide a refund under remedy 2.

WHAT DOES THIS GUARANTEE NOT COVER?

This Guarantee does not cover anything other than what is provided under “WHAT DOES THIS GUARANTEE COVER?” above, including, but not limited to, not covering: (1) damage to the Filter, (2) a Filter that is not Compatible with your refrigerator due to you answering the questions provided by the Selection Tool incorrectly and (3) anything covered by Second Nature’s Limited 30-Day Warranty on Refrigerator Water FilterReplacement Cartridges, which can be found at https://www.secondnature.com/terms-of-service and in the packaging originally provided with the Filter.

WHAT IS THE PERIOD OF COVERAGE?

This Guarantee starts on the date theFilter is delivered to the address set forth in the Filter order and lasts for thirty (30) days (the “Guarantee Period”). The Guarantee Period will not be extended for any reason unless SecondNature provides a Replacement Filter as a remedy under this Guarantee, in which case, the Guarantee Period will be extended until thirty (30) days after that ReplacementFilter is delivered to the address set forth in the original Filter order. Second Nature may amend, suspend or discontinue this Guarantee in its sole discretion without notice.

HOW DO YOU OBTAIN WARRANTY SERVICE?

To exercise your rights under thisGuarantee, you must contact Second Nature at https://help.secondnature.com/hc/en-us/requests/new or 1-800-308-1186 during the Guarantee Period. Second Nature will verify that you are the original purchaser of theFilter at this time and provide step-by-step instructions for processing any claim under this Guarantee.  For sanitation reasons, please do not send any Filter back to Second Nature.  

LIMITATION OF LIABILITY/DISCLAIMERS

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND SECOND NATURE’S ENTIRE LIABILITY FOR ANY BREACH OF THIS GUARANTEE.  SECOND NATURE WILL NOT UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

THIS GUARANTEE IS IN ADDITION TO AND DOES NOT MODIFY SECOND NATURE’S LIMITED 30-DAY WARRANTY ON REFRIGERATOR WATER FILTER REPLACEMENT CARTRIDGES, WHICH CAN BE FOUND AT HTTPS://WWW.SECONDNATURE.COM/TERMS-OF-SERVICE AND IN THE PACKAGING ORIGINALLY PROVIDED WITH THE FILTER.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.  SECOND NATURE SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  SOME STATES DO NOT ALLOW DISCLAIMER OF IMPLIED WARRANTIES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.  TO THE EXTENT SUCH WARRANTIES CANNOT BE DISCLAIMED, SECOND NATURE LIMITS THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY.  SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
