Second Nature Payments Terms and Conditions

The Second Nature Payments Terms and Conditions (“Terms”) are an agreement between you and Second Nature Brands, Inc. (“Second Nature”, “we” or “us”) and are effective upon your use of Second Nature’s online payment service (“Second Nature Payments”). Use of Second Nature Payments is also subject to the Second Nature Privacy Policy, https://www.secondnature.com/privacy-policy,  and any other legal agreements that apply to you as a user of Second Nature products and services (collectively, the “Related Agreements”). Your use of Second Nature Payments constitutes acceptance of these Terms and all Related Agreements and grants us authorization to process any payment transactions submitted through Second Nature Payments and obtain payment for all fees you incur or agree to incur through use of Second Nature Payments.


Second Nature’s Second Nature Payments allows you to make one-time payments for balances due to your property manager through our leasing platform. Second Nature Payments is not available for in-person payments. Payment(s) made through Second Nature Payments may only be made with a bank account (ACH) or credit card or debit card that we accept that you have authorization to use, and for which you have provided us with the correct information that we require to process the payment. We may elect to accept or decline any banking institution, credit card, or debit card for any reason, in our sole discretion. The payment amount, along with any applicable payment processing fees, will be debited from, or charged to, your payment method upon submission of your Second Nature Payments request and Second Nature will send your payment to your property manager via electronic payment transaction. Depending on your payment method used and/or the financial institution or credit card company, your payment will be credited to your account with your property manager within five (5) business days. To assure timely payment to your property manager, you must have requisite available funds and submit Second Nature Payments transaction requests before the date payment is required to be made. Any payments submitted on a weekend or holiday may be processed on the next business day. Second Nature shall have no liability in the event a Second Nature Payments transaction cannot be completed due to insufficient funds in your account, unavailability of a funding instrument, or the payment has been blocked or delayed for any reason. Further, Second Nature shall have no liability in the event a Second Nature Payments transaction cannot be initiated, modified or canceled due to system maintenance or outages.

This Policy applies to any information we collect through our Website, including any information in any e-mails, posts, texts and other electronic messages between you and our Website, and any information about you transferred to our Website from other websites.  This Policy also applies to any information we collect about you when you mail us or e-mail, text or exchange other electronic messages with us, or when you interact with messages you receive from us, and any information we collect from you offline but that will be processed by automated means using our Website, and information we collect from you when you contact our customer service center. This Policy does not apply to any other information we collect by any other means.

The payment method information supplied at the time of using Second Nature Payments is processed using our payment service provider (“Payment Processor”). You are responsible for the accuracy and completeness of all information you provide in connection with each Second Nature Payments transaction you initiate or cancel. Second Nature shall have no liability for a declination of payment resulting from your provision of inaccurate information. We do not retain any banking, debit or credit card information. The Payment Processor may retain additional information concerning you and your banking, debit or credit card information. Use of the information by the Payment Processor is governed by the Payment Processor’s privacy policy https://www.adyen.com/policies-and-disclaimer/privacy-policy Second Nature Payments is provided using the Payment Processor through a secure website; however, you acknowledge through use of Second Nature Payments that your personal information, including, without limitation, financial information, transmitted over the Internet may be susceptible to interception, misuse, hacking, theft and/ or fraud. 

When using Second Nature Payments, you represent and warrant the following:

• You are 18 years of age or older;
• You have the authority to accept and agree to these Terms;
• You are the account holder listed on the bank account, the account holder of the credit or debit card, or you have express authorization to use such bank account, credit card, or debit card;
• That the information you provide is accurate and complete; and
• There are sufficient funds and/or sufficient credit available under the payment method used at the time of submitting the Second Nature Payments transaction to fund the payment in full.

No chargebacks are permitted. If we are unable to charge your bank account, debit or credit card for any reason, we retain the right to assess additional charges up to the maximum amount allowed by law, assessed against us for such chargeback or payment failure, and as a result, you may be subject to suspension of your ability to use Second Nature Payments in our sole discretion. Second Nature reserves the right, subject to applicable law, to limit, block or place a hold on certain payment methods used, whether due to suspected fraud or other reasons, and/or suspend your access to the Second Nature Payments service at any time and in our sole discretion.

WE AND/OR THE PAYMENT PROCESSOR SHALL NOT BE LIABLE FOR ANY INACCURACY, ERROR, DELAY IN, OR OMISSION RELATED TO YOUR USE OF SECOND NATURE PAYMENTS THAT IS NOT CAUSED, DIRECTLY AND IN WHOLE, BY US AND/OR THE PAYMENT PROCESSOR. UNDER NO CIRCUMSTANCES SHALL WE AND/OR THE PAYMENT PROCESSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER, INCLUDING PUNITIVE OR EXEMPLARY ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF SECOND NATURE PAYMENTS. NEITHER WE, NOR THE PAYMENT PROCESSOR, MAKE ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO PROCESSING OF PAYMENTS UNDER THESE TERMS.

If any conflict exists between the Terms and any Related Agreements, the Terms shall control with respect to Second Nature Payments to the extent of the conflict. These Terms will be governed by the law of the state of North Carolina without regard to choice or conflicts of law provisions.  This Agreement contains the entire agreement between Second Nature and you related to Second Nature Payments, and any other written or oral statements does not change this Agreement. The Terms may only be modified by Second Nature.  We may assign our rights and duties under these Terms to any party at any time without notice to you. If any provision of these Terms is found to be unenforceable or invalid, the Terms unaffected provisions will remain in effect. If we fail to enforce or waive any requirement under the Terms, such failure to enforce or waiver does not waive that our right to later enforce that requirement in the future. We may amend these Terms at any time by posting a revised version on our website. The revised version will be effective at the time we post it unless otherwise noted.
