We at Second Nature Brands, Inc. (referred to herein as “we”, “us” or “our”) respect your privacy and are committed to protecting it through our compliance with this RBP Services and Platform Privacy Policy (this “Policy”). This Policy describes the types of information we or our service providers acting on our behalf may collect from or about you or that you may provide to us, including when you use or otherwise interact with our residential benefits package services (the “RBP Services”), web-based resident experience software platform (the “Platform”), web-based resident portal (the “Portal”), and/or our websites located at residents.secondnature.com and/or secondnature.com and all subpages thereof (the “RBP Customer Support Websites”), and our practices for collecting, using, maintaining, protecting, and disclosing that information. In this Policy, the Platform, Portal and RBP Customer Support Websites collectively may be referred to as the “RBP Software,” and the RBP Software and RBP Services collectively may be referred to as the “RBP Offerings.”
This Policy applies to any information we collect or otherwise process from or about individual residents and tenants of one of our business customers enrolled in our RBP Offerings, accessing, using or otherwise having their Personal Information (as defined below) processed by or through our RBP Offerings in connection with our delivery of such RBP Offerings to our business customers. This includes information we collect or otherwise process: (i) when such residents or tenants directly use, interact with or otherwise have their Personal Information processed by or through our RBP Offerings; (ii) in any e-mails, posts, texts and other electronic messages between such residents or tenants and us in connection with our delivery of the RBP Offerings to our business customers, including (but not limited to) those sent to us by such residents or tenants through our RBP Software; and (iii) when such residents or tenants contact us in connection with our delivery of the RBP Offerings to our business customers, such as by calling our general office or toll-free telephone numbers, by e-mailing us at the general company e-mail addresses (such as info@secondnature.com, support@secondnature.com, etc.) or by submitting online “contact us,” “support request” or similar web forms, in each case that are listed or found on our RBP Customer Support Websites or otherwise within the RBP Software.
This Policy does not apply to information we collect or process in any other context or by any other means. This Policy does not apply to officers, employees, contract workers or other authorized users of a business customer, or to customers, property managers, or clients of a business customer, in each case who are not themselves residents or tenants of that business customer; such individuals, together with the business customer itself, are instead subject to our General Business and Website Privacy Policy, available online at www.secondnature.com/privacy-policy, and information collected from or about such individuals is not governed by this Policy. For example, if you are an officer, employee, contract worker or other agent of an actual or prospective business customer of our RBP Offerings browsing our general corporate website located at secondnature.com, interacting with us in a sales context, or otherwise interacting with us in a business context other than in connection with our delivery of our RBP Offerings to our business customers, then this Policy does not apply to any information collected or processed by us in such contexts. Please see the General Business and Website Privacy Policy provided hereinabove for information about the privacy policy that governs our collection and processing of information in such contexts.
In the remainder of this Policy that follows this paragraph, “you” are the individual resident or tenant of a business customer described in the paragraph above titled “When This Policy Applies”.
Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, at least as between you and us and subject to the section below titled “Our Role as Service Provider / Processor To Our Business Customers,” we note that you can choose not to use or otherwise interact with our RBP Offerings or otherwise provide us with any Personal Information. By accessing or using our RBP Offerings or otherwise providing us with any Personal Information, you agree to this Policy. This Policy may change from time to time. When we make changes to this Policy, we will post the updated Policy on our RBP Software and update the Policy’s “last modified” date. We will also provide notice of any material changes as explained in the section below titled “Changes to Our Privacy Policy.” Your continued use of our RBP Offerings after we make changes is deemed to be acceptance of those changes.
We make the RBP Offerings available for access and use by and for the benefit of our business customers that have enrolled in such RBP Offerings (our “Business Customers”), under and pursuant to our contract with such Business Customers (our “Contracts”).
We are a service provider to the Business Customer, permitting them to use our RBP Offerings for their business purposes under and pursuant to our Contracts. In turn, we permit you to access and use the RBP Offerings in connection with the Business Customer’s permitted use of the RBP Offerings under our Contracts. We collect information through your use of or otherwise in connection with our delivery of the RBP Offerings to our Business Customer and process that information on the Business Customer’s behalf and under the Business Customer’s control and direction, pursuant to our Contract with the Business Customer. As between you and us, we commit to you that we will collect and process your information in accordance with this Policy, as part of the services we provide to the Business Customer. However, as between you and the Business Customer, with respect to information about you that you submit to the Business Customer or that the Business Customer otherwise obtains through use of the RBP Offerings, each Business Customer independently has the right to determine the purposes for which it will process such information and the means the Business Customer will use to process such information. The Business Customer is the “owner” of this information, at least as between us and them. We do not control (and are not and will not be responsible for) the applicable Business Customer’s policies and practices relating to the collection, use, maintenance, protection, disclosure or other processing of your information, including information about you that you submit to the Business Customer or that the Business Customer otherwise obtains through your use of the RBP Offerings. We only control (and are only and will only be responsible for) our own actions and the actions of our own service providers, as described in this Policy. We encourage you to review the responsible Business Customer’s own privacy policies or consult with a representative of the Business Customer for more information about how the Business Customer may collect, use, maintain, protect, disclose or otherwise process your information.
Personal Information We Collect - Generally
We may collect several types of information from and about you in connection with our RBP Offerings. This information may include information by which you may be personally identified or other information about you to the extent maintained in personally identifiable form (collectively “Personal Information”). Specifically, we (or our third-party service providers acting on our behalf) may collect the following from you:
Personal identifiers and contact information, such as your name, postal or billing address, e-mail address, telephone number (including mobile telephone number), account or username information, and the IP Address or Mobile Device ID of the computer or device used to access and use our RBP Software (“Identifiers”);
Payment information such as your credit card number, debit card number, expiration dates and security codes, and other similar or related account and authentication data necessary to process payment transactions via the RBP Offerings (“Payment Information”). Please note that the third-party payment processor that we have engaged to securely process payment transactions via the RBP Offerings collects this information directly from you and processes this information on our behalf without sharing this information with us, and we do not at any time directly store or have access to any Payment Information;
Demographic information, such as your age / date of birth, gender, profession, education, income range, the median home value of homes in your neighborhood (“Demographic Information”);
Commercial information, including products or services purchased, obtained or considered, or other purchasing or consuming histories or tendencies (“Commercial Information”);
The Technical Information described in the section below titled “Traffic, Usage, and Computer/Device Information;”
Information related to your Internet or other similar network activity, including browsing history, search history, and information on your interaction with our RBP Software (“Internet Activity”); and
Any other information (including Personal Information) you choose to provide in any communications, forms or messages submitted by you to us through or in connection with the RBP Offerings or using the contact information or tools on our RBP Customer Support Websites or otherwise.
Sensitive Personal Information
Except as expressly described above in regards to the Demographic Information we may collect from or about you in connection with the RBP Offerings, we do not knowingly collect sensitive Personal Information about you, such as government-issued identifying numbers; financial account details; precise geolocation information; information about your racial or ethnic origin, citizenship or immigration status, religious or philosophical beliefs, or union membership; the contents of your mail, email, or text messages unless we are the intended recipient of the communication; genetic data; neural data; biometric information for the purpose of uniquely identifying you; information concerning your health; or information concerning your sex life or sexual orientation (collectively, “Sensitive Personal Information”). With respect to the Demographic Information we do collect, and otherwise in the event that we do at any time collect any Sensitive Personal Information, we will use such information on a limited basis only (i) as necessary to perform those services that would be reasonably expected in the course of our delivery of the RBP Offerings to our Business Customers or otherwise in response to your outreach or request of us; (ii) for purposes of helping to ensure security and integrity to the extent the use of such Sensitive Personal Information is reasonably necessary and proportionate for these purposes; (iii) for short-term, transient use, including, but not limited to, non-personalized advertising shown as part of your current interaction with us, provided that the Sensitive Personal Information is not disclosed to another third party and is not used to build a profile about you or otherwise alter your experience outside your current interaction with us; (iv) as a service provider to another business performing services on behalf of that business (such as our delivery of the RBP Offerings to our Business Customers), including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on behalf of the business; (v) for purposes of undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by us; or (vi) as otherwise permitted by applicable law and regulations.
How We Collect Information
With the exception of Technical Information and Internet Activity information (which we or our third-party service providers collect automatically as you navigate through or interact with our Website, as described below in the section titled “Traffic, Usage and Computer/Device Information”), we primarily collect your Personal Information either (i) from our Business Customer who is using our RBP Offerings in connection with their relationship to you, or (ii) directly from you when you provide it or submit it to us directly in connection with registering an account associated with our RBP Offerings, using our RBP Offerings, completing transactions using or in connection with the RBP Offerings, requesting additional information from us (such as by signing up to receive alerts relating to the RBP Offerings), responding to a voluntary survey you have agreed to complete, contacting us for service inquiries or to report a problem with our RBP Offerings, submitting an inquiry to us using the contact methods or customer support tools provided on our RBP Customer Support Websites or otherwise, or otherwise contacting us about our RBP Offerings and our business.
Additionally, as you navigate through and interact with our RBP Software or certain emails, texts, and other electronic messages we send to you, we or our third-party service providers may automatically collect certain traffic data, usage information, and information about your computer equipment or mobile device, such as your browser and operating system, your wireless carrier, configuration data, clickstream analytics and your actions and patterns when you use our RBP Software (“Technical Information”). The technologies we use for this automatic data collection may include cookies that are stored on the browser of your computer or mobile device, small embedded electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) and other types of embedded code. We collect this information to (i) manage our content and improve users’ use of our RBP Software, (ii) count and review the number of users of our RBP Software and their usage patterns, (iii) track key performance indicators such as pages accessed, frequency of access and other statistical information related to our RBP Software (for example, recording the popularity of certain content and verifying system and server integrity), (iv) identify the portion of users who access our RBP Software via different web browsers, (v) recognize if a user is a return user of our RBP Software, (vi) to store information about a user’s visits, (vii) remember a user’s preferences, and (viii) for similar purposes in connection with monitoring, operating, maintaining and improving our RBP Software and our products and services. Third parties may also collect Technical Information and other information as further described in the section below titled “Use of Google Analytics.”
Generally
We may use the information we collect about you or that you provide to us, including Personal Information, to:
Provide our RBP Offerings to our Business Customers, including processing your Personal Information in connect therewith (and in accordance with our Contracts with the Business Customers);
Provide you with the information you request from us;
Process your transactions and payments via the RBP Offerings or otherwise, including by transmitting certain of your Personal Information (including Payment Information) to the third party payment processor that we use for securely processing payment transactions, and to prevent transactional fraud;
Create, maintain, customize and secure your account associated with the RBP Offerings;
Authenticate or otherwise verify your identity in connection with your requests, transactions, payments and inquiries via the RBP Offerings or otherwise;
Provide you with support and respond to your inquiries and support requests, including to investigate and address your concerns and to monitor and improve our responses;
As may be directed or permitted by our Business Customers, provide you with informational and promotional content and materials regarding the products and services of the Business Customer or third parties that may be of interest to you;
Provide you with informational and transactional text message alerts and e-mail communications;
Help maintain the safety, security, and integrity of our RBP Offerings, databases and other technology assets and our business;
Perform research and development activities, which may include, for example, conducting data analyses in order to develop new products and services or to improve existing products and services, and performing quality control activities;
Update and maintain customer or e-mail lists;
Notify you about changes to our RBP Offerings, products and services;
With respect to automatically collected traffic, usage and device information, fulfill the purposes described in the section above titled “Traffic, Usage and Computer/Device Information”;
With respect to aggregated and de-identified information, fulfill the purposes described in the section below titled “Use and Disclosure of Aggregated and De-Identified Data”;
Respond to lawful requests for information through court orders, subpoenas, warrants and other legal processes or obligations;
Enforce any contracts between you and us, including for billing and collection, or for the establishment, exercise or defense of legal claims;
Evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of a bankruptcy, liquidation, or similar proceeding, in which information (including Personal Information) held by us is among the assets transferred;
Fulfill any other purpose for which you provide the information; and
Serve any other purpose that we describe when you provide the information and for any other purpose with your consent.
We may convert or combine some Personal Information of users into de-identified or aggregated data that does not disclose any of the Personal Information of any individual user. As an example, we may de-identify or aggregate information provided by or collected about you and other visitors to our RBP Software to generate aggregate trends or insights about the behavior of visitors to our RBP Software generally that may be shared (including for commercial purposes) with third parties. You understand and agree that we may use and disclose to third parties any such de-identified or aggregated data for any lawful purpose.
“Tracking” (as used in this section of our Policy) involves the use of cookies, web beacons, or other embedded code or tracking technologies to collect, analyze and store information on a user’s behavior over time on multiple sites, including information on the sites visited, products viewed, products purchased and other online interactions, to enable companies to make interest-based (behavioral) advertising available to users on multiple sites that they visit.
We do not collect Personal Information about your online activities over time and across third-party sites for tracking purposes when you use our RBP Software. In addition, we do not permit other parties, including third-party advertisers, ad networks, ad servers, Internet providers or mobile device providers, to use cookies, web beacons, or other embedded code or tracking technologies to collect Personal Information about your online activities over time and across third party sites for tracking purposes when you use our RBP Software.
Therefore, our RBP Software does not respond to any “do not track” signals sent by your computer, browser or mobile device, and if your computer, browser or mobile device sends a “do not track” signal to our RBP Software, our RBP Software will not treat you differently from users who do not send such signals. We use Google Analytics to track and analyze certain traffic and usage statistics regarding the use of our RBP Software, such as the number of visitors to our RBP Software, how visitors are navigating to our RBP Software, visitors’ general geographic region information, how long individuals are visiting our RBP Software, and information about the equipment individuals are using to access our RBP Software (e.g., browser version and operating system). Google Analytics may use a Google Analytics cookie as part of this service, and we may share certain Personal Information with Google Analytics as part of this service. We use this traffic and usage information to gauge, internally, the effectiveness of our advertising efforts and to make improvements to our RBP Software.

You can opt out of our use of certain Google Analytics features by updating the “Ads Settings” in your browser or mobile device (support.google.com/My-Ad-Center-Help/answer/12155656), or by enabling the Google Analytics Opt-out Browser Add-on in your browser (tools.google.com/dlpage/gaoptout). Because those opt-out and preference control pages are specific to the individual browser used to visit it, and because those pages are not operated by us, we are unable to perform the opt-outs on your behalf.
Generally
We may sell and/or share your Personal Information with third parties in the following circumstances:
We may disclose Technical Information and all forms of Personal Information for the purposes described above, including Identifiers, Demographic Information, Commercial Information and Internet Activity, but not Payment Information (which is collected directly from you and processed by our third-party payment processor only and such information is not shared with us or or shared by us with any other party).
We do not sell, and in the past 12 months we have not sold, any Personal Information to third parties, within the meaning given to the terms “sale,” “sell” and “sold” under applicable privacy laws. Additionally, we do not share any Personal Information with third parties for the purpose of targeted advertising, online behavioral advertising or cross-context behavioral advertising—and have not done so in the past 12 months.
We will retain your Personal Information for no longer than is reasonably necessary to achieve the legitimate business purposes or uses stated in this Policy unless a longer retention period is required or allowed by the applicable privacy law or to otherwise fulfill a legal requirement. We use the following criteria to determine the applicable period to retain your Personal Information:
our legal and/or contractual obligations to keep or delete your Personal Information.
Generally
You have certain choices regarding the Personal Information you provide to us. You can set your browser to refuse all or some browser cookies. If you choose not to accept cookies, you may be unable to access certain parts or pages of our Website, or certain parts or features of our Website may not function properly. Data Subject Rights Requests
Applicable laws may provide you with the right to access, review, change, correct and/or request the deletion of certain portions of your Personal Information, or exercise other rights in relation to your Personal Information (“Rights Requests”). However, as noted above in the section titled “Our Role as Service Provider / Processor To Our Business Customers,” with respect to the collection and processing of your Personal Information under this Policy, we are a service provider (under some privacy laws referred to as a “processor”) to our Business Customers, and such Rights Requests must instead be submitted to our Business Customer that determines and controls the purposes and means of processing your Personal Information. If you submit a Rights Request directly to us, then, unless otherwise agreed in our Contract with the applicable Business Customer, we will respond to the request by informing you that the request cannot be acted upon because we are a service provider (or processor) and that such request must be directed to the applicable Business Customer.
If you are a California resident and you choose to exercise any of the rights described in the section titled “California Residents: Requests to Know, Correct, or Delete Personal Information,” you will not receive differential treatment by us as a result (e.g., different prices or quality of services), except to the extent permitted by applicable law (including if those differences are reasonably related to the value of your Personal Information).
The California Civil Code permits California residents with whom we have an established business relationship to request that we provide a list of certain categories of Personal Information that we have disclosed to third parties for their direct marketing purposes during the preceding calendar year. To make such a request, please send an e-mail to legal@secondnature.com or otherwise contact us using the information set forth below. Please mention that you are making a “California Shine the Light” inquiry. Please note that we may disclose your Personal Information to third parties for their direct marketing purposes and your continuous use of the RBP Offerings is considered your affirmative consent of such purposes.
Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statues Chapter 603A may submit a request by contacting us at legal@secondnature.com. Please note, however, that we do not currently sell any Personal Information to third parties within the meaning of this statute.
Our RBP Software is hosted in the United States and our RBP Offerings are provided from the United States. It is possible that certain information will be stored on servers in multiple other countries on the “cloud” or other similar distributed hosting platforms. If you are accessing our RBP Software or otherwise providing your Personal Information to us from Canada, the European Economic Area and the United Kingdom, Asia or any other jurisdiction with laws governing personal data collection, use, and disclosure that differ from United States laws, please note that by providing your Personal Information to us, you are expressly and knowingly consenting to the transfer of your Personal Information to the United States and other jurisdictions (where laws may differ from the laws of your jurisdiction) and to our use and disclosure of your Personal Information in accordance with this Policy.
Our RBP Software may include links to blogs, social media and third-party websites. These third-party sites have their own privacy policies and terms of use and are not controlled by this Policy. You should carefully review any terms, conditions and policies of such third-party sites before visiting them or supplying them with any personal information. If you follow a link on our RBP Software to any third-party site, any information you provide to that site will be governed by its own terms of use and privacy policy and not this Policy. You may be able to use social media widgets (e.g., the Facebook “Like” button) while using our RBP Software. These widgets will collect your IP Address and identify which page you are visiting on our RBP Software and make your preference information available to third parties. The information collected by such widgets is controlled by third-party privacy policies.
We are not responsible for the privacy or security of any information you provide to a third-party website or the information practices used by any third-party site, including links to any third-party site from our RBP Software. We make no representations, express or implied, concerning the accuracy, privacy, safety, security, or the information practices of any third-party site. The inclusion of a link to a third-party site on our RBP Software does not constitute any type of endorsement of the linked site by us. We are not responsible for any loss or damage you may sustain resulting from your use of any third-party website or any information you share with a third-party website.
Our RBP Offerings are not intended for children under 18 years of age, and we prohibit anyone under the age of 18 from providing any information to us or others on or using our RBP Offerings. We do not knowingly collect, maintain or use the Personal Information from children under the age of 18, and no parts of our RBP Offerings are directed to children. If you are under 18 years of age, do not use our RBP Offerings or provide any information about yourself to us, including your name, address, telephone number, e-mail address, IP Address or Mobile Device ID, or any screen name or username you may use. If we learn we have collected or received Personal Information from a child under 18 years of age without verification of parental consent, we will delete that information. If you believe we might have collected any information from or about a child under the age of 18, please contact us at legal@secondnature.com.
We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration and disclosure.
The safety and security of your information also depends on you. When we have given you (or when you have chosen) a password for access to certain parts of our RBP Software, you are responsible for keeping that password confidential. We ask you not to share your password with anyone.
Unfortunately, the transmission of information over the Internet is not completely secure. Although we have implemented security measures that we think are adequate, we cannot guarantee the security of your Personal Information transmitted to our RBP Software. Any transmission of Personal Information, including sensitive Personal Information, is at your own risk. We are not responsible for the circumvention of any privacy settings or security measures contained on the RBP Software.
When you register an account on the RBP Software and include your mobile telephone number at registration, or when you initiate text message communications with us by texting us at a number we have provided to you, you will be given an option to participate in our SMS text message program (the “Text Message Program”). We provide the Text Message Program to send you informational communications relating to the RBP Offerings, such as appointment reminders and work order status updates (“Informational Texts”), or in some cases for promotional marketing of RBP Offerings through your consent provided to our Business Customer. You will be given the option to receive our Informational Texts. By subscribing to the Text Message Program, you voluntarily authorize and direct us to send text messages using an automated system to the mobile telephone number you have provided. You are not required to use or subscribe to the Text Message Program as a condition of using the RBP Offerings or in order to benefit from other RBP Software features that are unrelated to the Text Message Program. Standard message and data rates may apply. Once enrolled in the Text Message Program, you may opt out of the Text Message Program (i.e., stop text messages) at any time. With respect to any text message, you may reply STOP, at which time we will reply by text to give you the option to stop Informational Texts (and after which we will stop sending the messages). You may also opt out by contacting us at legal@secondnature.com. If you contact us by e-mail please include “Text Message Opt Out” or similar language in the subject line of your e-mail, to assist us in our efforts to ensure prompt and proper processing of your e-mail request. Regardless of the method you use to opt out, please allow us a few days to process your opt out request.
We will post any changes we make to this Policy on this page. If we make material changes to how we collect, use or disclose Personal Information, we will notify you through a notice on our RBP Software. The date this Policy was last revised is identified at the top of the page. You are responsible for periodically visiting our RBP Software and this Policy to check for any changes.
